Dataset description

Track 1 land refurbishment projects are set up by the Flemish Government in accordance with the Decree of 28 March 2014 on land development. The establishment shall define the area of the land development project. One or more land development plans shall be established for each land development project. The Flemish Land Company applies land development to fully organise areas according to the area destination (nature, agriculture, recreation, housing,...) which has been granted according to the spatial planning and provides for a widely usable ‘instrument case’ for this purpose. Projects relating to the fitting-out of land, set up before the entry into force of the Decree of 28 March 2014, are implemented in implementation of Article 6a and Articles 11 to 14 of the Decree of 21 December 1988 establishing the Flemish Landmaatschappij. This decree defines the concept of ‘land development’ as ‘Promoting, Preparing, Integrating and Accompanying Measures, Acts and Works undertaken by the competent authorities and aimed at safeguarding, revaluing and making rural areas more suitable, in accordance with the spatial planning legislation.’ For each land development project, one or more plans were drawn up. The new 2014 land development regulations provide for a transitional arrangement for projects that started before the entry into force of the new legislation. This transitional arrangement means that the setting-up plans that have not yet been submitted for advice to the College of Mayors and Ships on 1 November 2014 will be drawn up as land development plans in accordance with the new rules on land design. Other authorities or partners of the Flemish Landmaatschappij can also use the fitting tools from the instrument case to achieve certain purposes on the ground. Both the Flemish Government and the provincial or municipal level can decide to do so. The initiating authority will then start working in consultation with the VLM. Instrument case The instrument case can be widely used in the areas of design, management, land acquisition, land mobility and accompanying policies. This includes, among other things, furnishings, reparcelling and exchange of uses. Since the new legislation, this has included: reparcelling from the force of law and right of pre-purchase. These instruments have a large geographical component and are therefore included separately in the Land Development Product Data Set.
