Areas with right of pre-purchase, special nature protection areas: Overview of the areas in which a pre-emption right has been established pursuant to Article 37(1), (2) and (6) of the Decree of 21 October 1997 on nature conservation and the natural environment (B.S. 10/01/1998). Special areas of conservation are areas designated by an EU Member State (e.g. Belgium) for certain habitats and/or species for the purpose of implementing the Birds or Habitats Directives. The right of pre-emption within these special protection areas is valid: — within the green and forest areas and the extension areas and the destination areas similar to all these areas, depending on the plans of construction or spatial implementation plans in force in the spatial planning; — in the search areas (delimited in accordance with Article 50s, §4, first paragraph of the Decree of 21 October 1997 on nature conservation and the natural environment) irrespective of the planological use in the approved plans for construction or spatial implementation plans.
