Public utility easements (SUPs) are administrative limitations on the right to property, they are established for the benefit of public persons, concessionaires of public works or public works, private persons engaged in an activity in the public interest. The collection and conservation of public utility easements is a sovereign task of the State, which must bring them to the attention of local and regional authorities so that they may annex them to their urban planning documents. The public utility easements concerned are those defined by Articles L. 126-1 and R. 126-1 of the Urban Planning Code and their annexes.
Type I3 SUPs result from the easements listed in Article L555-16 and R555-30 et seq. of the Environmental Code.
According to the technical note of 7 January 2016, it is specified that the exact scope of this easement must not be published on a scale greater than 1/25000th.
In the Puy-de-Dome 80 communes are concerned and for each of them a prefectural decree dated 5 May 2017 was issued in order to define the servitudes of public utility mentioned in the articles above. A map to 1/25000th is annexed to this decree.
The schedule of easements of land-based planning documents on a cadastral scale must therefore not bear the perimeter of this SUP. It is simply necessary to annex the Prefectural Decree concerning the municipality concerned with its plan to 1/25000th.
The GIS layer associated with this metadata gives the outline of the 80 municipalities concerned, with for each of them a link to the prefectoral decree to be annexed to the planning document.
