The revision of this flood risk prevention plan (PPR) linked to the presence of rivers Le Valescure and Le Pédégal in the commune of Fréjus was prescribed by prefectural decree of 7 February 2011.
The Risk Prevention Plans (P.P.R) codified in Articles L562-1 to L562-7 and R562-1 et seq. of the Environmental Code, relating to the prevention of foreseeable natural hazards, the implementation of which is governed by Decree No 95-1089 of 5 October 1995, constitute one of the tools for the implementation of the State policy on flood prevention, which was redefined in the Interministerial Committee of 24 January 1994.
This legislative and regulatory framework was supplemented by the Act of 30 July 2003.
The Plan for the Prevention of Natural Flood Risks in the commune of Fréjus, linked to the presence of the Valescure and Pédégal rivers, was approved by prefectural decree of 6 May 2002. It was revised on 7 February 2011. Certain provisions were immediately enforceable by prefectural order on 15 July 2015.
The new zoning thus carried out in the context of the PPRI project with certain provisions put into immediate third-party effectiveness is the one to which applies:
— the requirements of the 2002 Regulation for existing structures, constructions and installations and safeguard measures;
— the requirements of the 2015 draft Regulation for new constructions, structures and developments or new operations.
These regulations refer to prohibition and/or prescription measures depending on the different mapped areas.
A hydraulic study carried out from 2012 was used as the basis for the definition of hazard. The hazard thus realised on a photogrammetric background dating from 2008 allowed, after crossing with the stake map, to determine the regulatory zoning.
