Dataset description

This dataset contains the location of Classified Facilities for the Protection of the Environment (ICPE) (one-off) subject to a report (PAC) in New Aquitaine. ATTENTION: this dataset is not complete on the Nouvelle-Aquitaine perimeter, it concerns the former Poitou-Charentes region. The hazard studies of certain installations classified for the protection of the environment show that the distances of effects (calculated according to the effect thresholds fixed by the Decree of 29 September 2005) of accidents likely to occur within the premises of these establishments may exceed where necessary outside the limits of ownership of the industries concerned. It is therefore necessary to control future urbanisation in a graduated manner around these sites to limit the risk exposure of riparian populations. The regulations provide for several types of approach functions of the administrative status of the industries causing these ranges of effects: — for high-threshold SEVESO establishments (classified below the AS threshold of the classification of classified facilities), it is appropriate to prescribe Public Utility Servitudes (SUPs) which are enforceable against third parties. — for older SEVESO establishments, the regulations provide for the enactment of Technological Risk Prevention Plans (PPRTs) which are also enforceable against third parties but which take into account, unlike SUPs, urban planning already in place. For other undertakings falling, in particular, under the threshold of simple authorisation or of the SEVESO low threshold of the classification of classified installations, the circular of 4 May 2007 provides for bringing to the attention (PAC) of the town halls the extent of the hazard zones determined by the calculation of the effects distances indicated above. The circular of 4 May 2007 also provides for a proposal for town halls to manage urban planning within these areas in proportion to their level of danger. On the other hand, specific sectoral texts call for certain industries to be, at the time of their establishment, distant from third parties and that this remoteness be maintained over time. This is particularly the case with cereal storage silos very present in Poitou-Charentes. In the end, bringing them to light may be the superposition, for a given site, of urban planning constraints enacted according to the circular of 4 May 2007 but also of the decree of 29 March 2004 on silos.
