Servitudes instituted pursuant to Articles L. 6351-1 1° and L. 6351-2 to L. 6351-5 of the Transport Code (formerly R. 241-1 to R. 242-3 of the Civil Aviation Code).
These are servitudes, known as “aeronautical release services”, created to ensure the safety of aircraft traffic, excluding radio easements. They are defined as:
— by an aeronautical release easement plan (PSA) drawn up for each aerodrome referred to in Article L.6350-1 1° and 2° of the Transport Code (former R. 241-2 of the Civil Aviation Code),
— or by provisional safeguard measures which may be implemented in the event of an emergency, before being included in an approved PSA.
These aeronautical release easements shall include:
— the prohibition on the creation or the obligation to modify or even remove obstacles likely to constitute a danger to air traffic or harmful to the operation of safety devices (light, radio or meteorological) established in the interest of air navigation,
— the prohibition on carrying out major repairs or improvements on buildings and other works subject to aeronautical easements exempted from the building permit without the authorisation of the administrative authority.
The generator consists of the axis of the runway(s) and the final approach and take-off area(s).
The plans attached to the decree shall indicate the X,Y coordinates of the end(s) of the runway(s) or of the runway axis terminals and the centre of the final approach or take-off area(s).
These infrastructure points are reproduced using the information contained in the plan.
