Category AC4 easements concern areas for the protection of architectural, urban and landscape heritage and areas for the enhancement of architecture and heritage.
Areas for the protection of architectural, urban and landscape heritage (ZPPAUP):
Established by Articles 69 to 72 of Law No 83-8 of 7 January 1983 on the division of powers between municipalities, departments, regions and the State, the ZPPAUPs were intended to delimit spaces built or not built around historical monuments and in the districts, sites and spaces to be protected or enhanced for aesthetic, historical or cultural reasons.
Within these areas, specific architectural and landscape requirements were laid down for construction, demolition, deforestation, transformation and alteration of the appearance of buildings.
These areas now evolve into “Areas of Enhancement of Architecture and Heritage”.
Architectural and Heritage Enhancement Areas (AVAPs):
Article 28 of Law No 2010-788 of 12 July 2010 on the national commitment for the environment, known as the Grenelle II Act, introduced the AVAP system which, without calling into question the founding principles, now replaces that of the ZPPAUP.
This new scheme aims to develop a new approach to the qualitative management of territories by integrating the sustainable development goals into the heritage and urban approach of the ZPPAUP.
The Law of 12 July 2010 established a period of 5 years, from the date of its entry into force, for municipalities to substitute AVAPs for ZPPAUPs. During this period, the ZPPAUPs shall continue to produce their legal effects.
In the ZPPAUPs still in force and in the AVAPs, works whose object or effect is to transform or alter the appearance of a building, whether built or not, are subject to prior authorisation, which may be accompanied by special requirements.
This resource describes the surface plates of servitudes of category AC4 confused with generators, namely a heritage of cultural, architectural, urban, landscape, historical or archaeological interest to be protected:
