Dataset description

Law No. 87-565 of 22 July 1987 on civil security organisation, forest protection, fire and major risk prevention strengthens the control of urbanisation in risk areas where public safety may be threatened. The law of 2 February 1995 on the strengthening of the protection of the environment specifies #x27; supervision of this master’s degree by introducing the Natural Risk Prevention Plans (PPRN). Decree No. 95-1089 of 5 October 1995 amended by the decree of 4 January 2005 defined the procedure and content of these documents. PRPPs are prescribed and approved by the Prefect; they are the subject of a consultation of municipalities and services interested in the project as well as a public inquiry. These plans shall include: — A presentation report indicating the geographical area concerned, the nature of the phenomena taken into account, and their possible consequences having regard to the state of knowledge; — A regulation that defines the measures d' prohibition and requirements applicable in each of the areas where a risk has been identified. It can be measures of urban planning (land use) or constructive arrangements (strengthening of buildings in particular). These measures apply to existing assets and activities, but also to new projects. They may be accompanied by measures to prevent, protect and safeguard persons and property mentioned in 3°; Article 40-1 of the Law of 22 July 1987; — A zoning plan which delimits the areas mentioned in 1 and 2 of Article 40-1 of the Law of 22 July 1987. Law No. 99-245 of 30 March 1999, known as Law " after mine; on liability for damage resulting from mining; mining and mine risk prevention has introduced the Minier Risk Prevention Plans (MRPs). Article 94 of the Mining Code provides that " L'State develops and implements plans for the prevention of mining risks (PPRM), under the conditions laid down in Articles L562-1 to L562-7 of the code de l'environment, also relating to Natural Risk Prevention Plans. This is Decree No. 2000-547 of 16 June 2000 which modeled the procedure of the Miniers PPRs on that of the Natural PPRs. The procedures for the development of PPRMs are specified in the circular of 6 January 2012 (repealing the circular of 3 mats 2008). The approved Risk Prevention Plan (PPRN or PPRM) has the value of easement of public utility under #x27; Article L 562-4 of the Code of the Environment. It must be annexed to the document d' existing urban planning. Its requirements shall be enforceable against any natural or legal person. Infringements of the requirements laid down in the PPRM, pursuant to II of Article L 562-1 of the Code of the Environment, are punishable by the penalties provided for in Article L 480-4 of the Code de l' urban planning. The constraints imposed on urban planning by the PPRM must include the fact that, pursuant to Article 75-1 of the Mining Code, Article 75-1 of the Mining Code, the State remains the guarantor of the mining damage that would be caused by the former mining operations, in the case of #x27; absence of a valid mining title or in the event of disappearance or failure of #x27; operator. The principles of this zoning are based on a confrontation between the different levels of the hazard and the #x27th; assessment of existing and future issues characterising the land use. This contingencies/stakes crossover is reflected in homogeneous sectors governed by their own regulations.
