Dataset description

This dataset contains the perimeters of the municipalities impacted by an effect band of a pipeline for the transport of dangerous goods, in the Nouvelle-Aquitaine region. Each municipality is accompanied by the rules for the control of urbanisation near a pipeline transporting dangerous materials (bring to the attention, information leaflet of the DREAL) and, if necessary, by its prefectural decree establishing the SUPs taking into account the control of the risks around the pipes. The distances of effects are those generated by the dangerous phenomenon known as a major reference (generated by a rupture or a breach of 70 mm). The following resource access box provides a schematic representation illustrating the positioning of the 3 effect bands. The distances displayed must be multiplied by two in order to have the total width of the corresponding effect band, i.e.: — to the IRE band = band of irreversible effects — to the PEL band (or SEL) = band of first lethal effects delimiting the area of serious danger to human life — to the band of ELS = Significant Lethal Effects band delimiting the area of very serious dangers to human life. Minimum urban planning rules are associated with each of the effects bands: — Inform the carrier of any application for a building permit or urban planning certificate granted in an area located at a distance from the pipeline less than the distance shown in the column entitled ‘IRE irreversible effects threshold’ in the municipal file. — Consult the carrier as upstream as possible for any project to construct or extend an establishment receiving the public (ERP) of more than 100 persons or a high-rise building (IGH) in the area ‘IRE irreversible effects threshold’ defined in the preceding paragraph. In fact, the construction or extension of IGH or ERP belonging to the 1st to the 3 rd category is prohibited in the ‘first lethal effects zone’ and in the ‘zone of significant lethal effects ELS’, this prohibition is extended to LES likely to receive more than 100 persons. Easements related to taking into account risks: Pursuant to Article R 555-30b of the Environmental Code, SUP public utility easements are instituted in the zones of effects generated by the dangerous phenomena likely to occur on the transport pipelines, in accordance with the distances set out in the prefectural decree of the municipality. These easements strictly regulate the construction and extension of establishments receiving the public (EPR) of more than 100 people and high-rise buildings (IGH) in accordance with the following procedures: • SUP1 easement, corresponding to the lethal effects zone (LEC) of the dangerous reference phenomenon increasing within the meaning of Article R.555-39 of the Environmental Code (in general to the rupture of the pipeline): the issue of a building permit relating to an ERP likely to receive more than 100 persons or to an IGH is subject to the provision of a compatibility analysis having received the favourable opinion of the carrier or, in the event of an unfavourable opinion of the carrier, the favourable opinion of the Prefect given in the light of the expert report referred to in III of Article R 555-31 of the Environmental Code. The compatibility analysis is established in accordance with the provisions of the Ministerial Decree of 5 March 2014 cited in reference. • SUP2 easement, corresponding to the lethal effects zone (LEC) of the reduced reference hazardous phenomenon within the meaning of Article R.555-39 of the Environmental Code (brief 12 mm diameter): The opening of an ERP likely to receive more than 300 people or an IGH is prohibited in this band of servitude. • SUP3 easement, corresponding to the zone of significant lethal effects (ELS) of the reduced reference hazardous phenomenon within the meaning of Article R.555-39 of the Environmental Code (brief 12 mm diameter): The opening of an ERP likely to receive more than 100 people or an IGH is prohibited in this servitude band. In addition, in accordance with Article R. 555-46 of the Environmental Code, the mayor informs the carrier of any building permit or urban planning certificate (information or operational) issued in one of the areas defined above. Construction and operating easements The easements related to taking into account the risks referred to in the above paragraph are complementary to the construction and operating easements (also referred to as “strong and weak server”) taken for pipes declared to be of public benefit or of general interest (band 4 to 10 meters wide depending on the diameters of the works). For the works concerned, the precise position of the strong and weak easements is available from the carrier.
