By means of the texts (Law 27/02/2002 applicable from the entry into force of its implementing decree of 18/05/2005), RNV (voluntary natural reserves) became RNRs (Regional Natural Reserves) from 20/05/2005, the date from which the owners had one year to request the withdrawal of their approval (which none did in Poitou-Charentes). As from the same date, the Prefect has lost all jurisdiction over these RNs, which is exclusively the responsibility of the Regional Council.
As a result, since the approvals were issued for a period of 6 years (former Art. R.242-31 of the Environmental Code), and tacitly renewed, all approvals in progress before 20/05/05 could be subject to a last tacit renewal for 6 years at the latest until 19/05/05, so that approvals could run until 19 May 2011.
Thus, ex-RNVs for which no deliberation of the Regional Council has explicitly declared their classification as RNR are considered as declassified: in this case, the RN has lost all status on the date of end of approval (i.e. 6 years to day after the date of the last tacit renewal of its approval before 20/05/05). This is so far the case of all the ex-RNVs of the ex-Poitou-Charentes.
The decision of the Regional Council classifying an ex-RNV in RNR may take place after the end date of approval, this will correspond to a “re-creation” of the reserve which has disappeared for a longer or shorter period during which no protective measure is enforceable. This is what is planned by the Regional Council in ex-Poitou-Charentes, which is in the process of preparing the files for the reclassification of ex-RNV to RNR.
The ex-RNVs of the former Poitou-Charentes region now have no legal status, but it is interesting to keep this data, which can only have as their name ex-RNV.
