Dataset description

This layer of polygons lists the perimeters of consideration (PCC) on Rennes Métropole. The principle of a Consideration Taking Perimeter (PPC) and a Statuer Survival Perimeter (PSS) is as follows: We take into consideration, within the meaning of Article L.424-1 of the Urbanism Code, an urban development or renewal project, for example, in a sector of the territory and it is specified that a stay of proceedings may be applied on this sector to any request for permission to build which could compromise this operation (for a period of 10 years if the operation is not undertaken until then). The notion of PPC and PSS is linked. This is why in the automated urban planning information developed by Rennes Métropole (in the AUCs), we display the following standard sentence when the case arises: “Field concerned by a scope of consideration (with possibility of suspension of stature)”. Where works, constructions or installations are liable to compromise or render more onerous the carrying out of a development operation within the scope of operations of national interest, the stay of proceedings may be opposed, under the conditions laid down in Article L. 424-1, provided that the planning project has been considered by the competent administrative authority of the State and the land affected by that project has been delimited’. The decision to take into consideration shall cease to have effect if, within ten years of its entry into force, the completion of the development operation has not been initiated. The decision to take into consideration (PCC) is introduced by the developer of the project taken into consideration (deliberative assembly for local and regional authorities, prefect for the State), by deliberation of the municipal council or the legislative body of the EPCI or by decision of the administrative authority (i.e. the developer of the project) which takes into account the already defined development project, or the studies that are launched and which will make it possible to define it. This deliberation must delimit the land concerned. The plan accompanying the decision must be sufficiently precise to allow identification of the parcels concerned (EC, 12 Nov. 2007, Minister of Equipment, No 281345). To be enforceable against an application for planning authorisation, the deliberation of “taking into consideration” must have been published (posting in town hall for one month, publication in a newspaper and transmission in prefecture) before the submission of this application.
