Article L 2111-7 of the General Code of Property for Public Persons lists navigable or floating rivers.
These rivers belong to the public river domain and are also referred to as federal watercourses.
Their maintenance is therefore the responsibility of the State unless it grants management and therefore maintenance to the regions or departments.
The State has an obligation to maintain the public domain of rivers and must maintain the proper flow of water.
The federal watercourse therefore belongs to the State; riparian owners must bear a tow and footage easement.
For the department of the Hautes-Pyrénées, the Garonne and part of the Neste, have the status of a federal watercourse.
The state portion of the Neste extends from the limit of department 65/31, to the confluence with the Garonne, for the downstream boundary, and the Agusseau Bridge, located on RD 929, upstream.
These federal watercourses are natural rivers, which are removed from the nomenclature of inland waterways, but are maintained in the public domain of rivers.
