The Hunting Act of July 2000 recognised night hunting from installation (hunting hut) in 27 departments where it was traditionally practised.
Existing facilities before the law have been registered, but any new construction has since been prohibited.
A hunting hut, to be used for night hunting of water game, must be registered and its owner must have a declaration receipt issued by the Departmental Directorate of Territories (or formerly by the Departmental Directorate of Agriculture and Forestry). The total number of huts for night hunting of water game has been fixed since January 1, 2001. Thus, any hut existing on 1 January 2000 whose owner did not declare to the Prefect before 1 January 2001 can no longer be used for night hunting of water game (Article R.424-17 of the Environmental Code).
This declaration has been the subject of a receipt from the Departmental Directorate of Territories and the Sea which assigns a fixed post number.
Articles L.424-5 and R.424-17 to R.424-19 of the Environmental Code govern night hunting of water game from a fixed station.
A hunting hut is a fixed post such as huts, huts, tons and gabions existing on 1 January 2000 in the department of Eure where this practice is traditional.
There are two procedures for registered hunting huts:
— The transfer of the hut declaration receipt in the case of a change in the owner of the hut;
— The movement of hut in the case of geographical movement of the hut:
The transfer of receipt is investigated on presentation of proof of transfer of ownership of the facility (notarial deed certifying ownership);
The request for travel shall be accompanied by an impact assessment on fauna and flora;
The installation of a new hunting hut as part of a movement must comply with public safety requirements.
