ICPE installations are subject to a nomenclature established by decree in the Council of State.An ICPE is an installation which is likely to cause harm or risk to the environment, by its activities and the products present on the site.- Case of “Seveso” sites: The Seveso Directive 2 of 1996 (which replaces the Seveso 1 Directive of 1989) concerns certain installations classified for the protection of the environment using dangerous substances or preparations.The Seveso Directive, contrary to the ICPE regulations, concerns only major industrial risks and does not address the issue of nuisances.This regulation introduces two classification thresholds: “Seveso Low Threshold” and “Seveso High Threshold”.The perimeters of the available establishments are either the perimeter of the land right of way or the fence perimeter (which is the most common case). Seveso or Directive 96/82/EC is an EU directive that requires EU Member States to identify industrial sites presenting major accident risks. Installations and plants likely to generate risks or hazards are subject to specific legislation and regulations, relating to so-called ‘environmentally classified installations’.
