Application Spaces * “wetlands (WZ) are defined as land, whether or not exploited, usually flooded or gorgated with fresh water, salted or brackish permanently or temporarily; vegetation, where it exists, is dominated by hygrophilic plants for at least part of the year” (Article L. 211-1 of the Environmental Code). * “the criteria for the definition of wetlands relate to soil morphology related to the prolonged presence of natural water and the possible presence of hygrophilic plants. In the absence of hygrophilic vegetation, soil morphology is sufficient to define a wetland” (Article R. 211-108 of the Environmental Code). * Wetlands known as the “Water Act” have a sufficiently precise definition under the Water and Aquatic Environments Act (LEMA). Their wet character was defined according to the soil or vegetation criteria listed in the Ministerial Order of 24 June 2008 as amended by the Order of 1 October 2009 specifying the criteria for defining and delimiting wetlands pursuant to Article R.211-108 of the Environmental Code. Their delimitation scale is in accordance with the same decree (scale from 1/5000th to 1/25000e). Objectives * Article L 211-1-1 of the Environmental Code affirms the principle that water is part of the nation’s common heritage: its protection, development and development of the usable resource, while respecting natural balances, is of general interest. The purpose of its legislation (the so-called “Water Act”) is to establish a balanced management of the water resource, which aims, inter alia, to ensure the preservation of wetlands, as defined above (Article L 211-1 of the Environmental Code).
