Delimitation of the mountain area, as urban planning, in the department of the Hautes-Pyrénées.
The mountain area includes municipalities characterised by limited land use opportunities and increased construction costs.
Municipalities or parts of municipalities subject to the urban planning provisions of the Law of 9 January 1985, known as the “Mountain Law”.
Article L.145-1 of the Urban Planning Code refers, for the purposes of applying the special planning provisions in mountain areas, to the mountain areas defined in Article 3 of the Law of 9 January 1985 and delimited
by inter-ministerial orders.
The mountain area to which the urban planning provisions of the mountain law apply is that defined by the inter-ministerial decree of 6 September 1985, signed by the Minister responsible for urban planning.
This area is also taken into account for the distribution of DGD assigned to urban planning.
Since 6 September 1985, other decrees signed by the Ministers of Agriculture, Economics and Finance have defined new mountain areas to support certain less-favoured areas, but these areas cannot be taken into account when defining the scope of the urban planning provisions specific to mountain areas.
