According to Article L422-1 of the Urban Planning Code, the examination of planning acts (planning certificate, building permit, prior declaration, planning permission) is a municipal competence for municipalities that have or have disposed of an urban planning document. Municipalities have the possibility of transferring this competence to a body with this competence. Under Article L422-8 of the Urban Planning Code, only municipalities belonging to an EPCI with less than 10,000 inhabitants may transfer this competence to the decentralised services of the State.
In the case of municipalities that have never been provided with a planning document, the State Services (DDT) are responsible for the investigation of planning acts.
