While the identification of major rivers is shared by all users, the difference between some streams and ditches or canals is sometimes more sensitive. However, this distinction has significant administrative consequences.
For the purpose of applying the provisions of Articles L214-1 to L214-6 of the Environmental Code (operations subject to authorisation under the Water Act), in an instruction dated 03 June 2015, the Ministry of Ecology, Sustainable Development and Energy thus requests the State services to carry out a watercourse mapping based on three cumulative criteria set out in Article L215-7-1 of the Environmental Code, namely:
— the presence and permanence of a bed, originally natural
— sufficient debit for most of the year
— power from a source
Thus, on this basis, the Corrèze DDT carries out progressively the mapping of flows which fall within the definition of watercourses.
