Public utility easements (SUPs) affecting land use are established according to the rules specific to each of the separate legislations of the Urban Planning Code. These administrative limitations on the right to property may be imposed for the benefit of public persons (state, local authorities, public establishments), concessionaires for public works or services (GRT Gaz), private persons engaged in an activity of general interest.
Where SUPs resulting from particular legislation directly affect land use or constructionability, they are included in a list drawn up by decree of the Council of State and annexed to Article R 126-1 of the Urban Planning Code.
They are divided into four main categories:
Easements relating to the conservation of heritage.
Easements relating to the use of certain resources and equipment.
Easements related to National Defence.
Easements related to public safety and health.
The data are not enforceable, only the paper-based PLU approved in the Community Council is enforceable against third parties.
