In the first quarter of each year, purchasers must publish the list of supply, services or works contracts concluded in the previous year (art. 133 of the Public Procurement Code). As from 1 January 2012, the procedures for the annual identification of contracts must comply with the new provisions laid down in the Decree of 21 July 2011.
Reduced number of tranches
The obligation of annual publicity does not apply to all public contracts. The threshold for triggering the obligation is set at EUR 20 000 excluding tax. Markets below this threshold are placed outside the scope of this census.
Then, within each category, contracts must be grouped, according to their amount, into different tranches, the amounts of which are specified by the implementing decree of 21 July 2011. The list distinguishes three tranches:
contracts between EUR 20 000 tax and EUR 90 000 tax,
EUR 90 000 excluding tax and the European thresholds,
and finally, those above the thresholds of formalised procedures.
Content of the information
Contracts must be presented by distinguishing between the type of purchase: works, supplies and services. Once the classification by sector of purchase and by tranche has been completed, the buyer must also include on the list, for each contract, the subject and date of the contract, the name of the successful tenderer, as well as the postal code of the contract holder.
