Category A5 easements relate to public water and sanitation pipeline easements.
It is established for the benefit of public authorities, public establishments or public service concessionaires who undertake work of; establishment of pipes of drinking water or of #x27; drainage of Â#x27; sewage or rainwater a servitude conferring on them the right to #x27; to permanently establish underground pipes in private land not built, except for courtyards and gardens adjoining the dwellings.
Servitude entitles the beneficiary to:
— d' bury one or more pipes;
— d' d' d' d' d' establishment and maintenance of the pipeline;
— d' access to the ground in which the driving is buried, with control officers enjoying the same right of access;
— d' carry out any work of maintenance and repair (The date of commencement of the work shall be notified to the owners and operators at least 8 days before the scheduled date for the start of the work. An inventory of the premises must, if necessary, be drawn up adversarially with a view to ascertaining any damage that may result from the said works).
Owners and their successors must refrain from doing anything that would adversely affect the proper functioning, maintenance and preservation of the work.
L' establishment of this servitude is entitled to compensation whose challenges are judged as in matters of expropriation because of public utility.
If the rejection of an application for a building permit is based on the ground; exercise of the right of easement in the parcel in question, its owner may request the permit; total acquisition of the parcel by the owner of the plot; construction, either by way of amicable, or by way of expropriation.
If the building permit is granted subject to a movement of the pipes, the costs of such travel shall be borne by the beneficiary of the easement
