Dataset description

Servitudes of public utility (SUP) are administrative limitations on the right to property, they are instituted for the benefit of public persons, concessionaires of services or public works, private persons engaged in an activity of the public interest; general interest. The collection and conservation of servitudes of public utility are a sovereign mission of the State which must bring them to the attention of the local authorities so that they annex them to their document d’' urbanism. The easements of public utility concerned are those defined by Articles L. 126-1 and R. 126-1 of the Code de l’' urban planning and their annexes. PT1-type SUPs are established pursuant to Articles L. 57 to L.62-1 of the Post and Electronic Communications Code in order to protect radio centres against electromagnetic disturbances that may result from the operation of certain equipment, including electrical equipment. Texts in force: — Articles L. 57 to L. 62-1 of the Post and Electronic Communications Code, — Article L. 5113-1 of the Defence Code, — Articles R. 27 to R. 39 of the Postal and Electronic Communications Code, — Order of 21 August 1953, as amended, relating to the establishment of the list and characteristics of electrical equipment, the placing into service, modification or conversion of which is subject to prior authorisation in radio guard zones. The servitudes instituted for the benefit of radio centres concerning national defence or public security shall be established by decree issued under the counterseing of the Minister concerned and the Minister for Industrial and Scientific Development, if favourable opinion of the ANFR; by decree in Council of State if unfavourable opinion of ANFR. The easements established for the benefit of radio centres owned by private operators are established by prefectural decree. In addition, for centres of the 1st and 2nd category, a radio guard zone shall be established within the protection zone. The plates are only surface type, circular, and represent a guard zone or a protective zone, and the same easement may have both.
