Under Articles L. 212-6 and L. 212-6-1 of the Heritage Code, local authorities, in particular, are owners and responsible for their archives. In the case of municipalities, this responsibility lies with the mayor, under the control of the municipal council. At each change of mayor and/or municipality, the drafting of a re-establishment of the archives annexed to the minutes of discharge and taking charge of the archives of the municipality is mandatory, and this is done in accordance with Article 4 of the interministerial decree of 31 December 1926. The minutes and retraining are used to formalise the transfer of responsibility from the outgoing mayor to the new mayor. They make it possible to certify in a contradictory manner the existence of the archives at a given time. the retraining is also a useful instrument for the director (or director) of the departmental archive department in the framework of the monitoring which he/she carries out as part of the scientific and technical control of the archives of the municipalities.
