Restrictive Business Practices (CBPs) — Total Amount of Transactions and Fines since 2012

Amount of PCR transactions and fines in euro since 2012. The non-compliances in terms of restrictive commercial practice (CBP) identified by DGCCRF officers are diverse. They may be linked to the formalism of the invoice (no invoice or a mandatory mention on the invoice), regulated payment periods, failure to comply with the deadline for signing the single annual agreement between suppliers and distributors (= 1 March), a commercial activity unlawfully carried out by an association (= paracommercialism), resale at a loss, at a minimum price imposed. A finding of a breach of PCR may lead to the drawing up of a report sent by the DGCCRF to the public prosecutor. If the record is not filed without action, the consequences which may be given to it are either a settlement or a judgment (1st instance), and possibly a judgment in the event of an appeal against that judgment.
