Dataset description
A subdivision is a land division (from the first division) carried out for the purpose of building, depending on its location or the presence of internal common roads, spaces or equipment, will either be subject to a prior declaration or a permit to develop (http://www.developpement-durable.gouv.fr, 09/2016). “A subdivision is the division into ownership or enjoyment of a land unit or of several adjoining land units whose purpose is to detach one or more lots intended to be built” (Article L.442-1 of the Urban Planning Code).
* Also, for precision, a subdivision is defined according to different criteria:
\- Intentional criterion: “division to detach one or more lots intended to be built regardless of the nature of the building (houses, agricultural buildings...)”. => when a land division is not carried out for this purpose, it is not subject to the regulations governing subdivisions.
\- Spatial criterion: “division of one or more land units”. => if there is no division of soil, there is no land division (volume divisions do not fall within this definition). Also, a subdivision cannot be multi-site.
\- Legal criterion: “division of ownership or enjoyment (lease for building, agreement of owner...)”. => the division into ownership corresponds to a transfer of land ownership with all the attributes of the property right and in particular the right to build. In the context of a division into enjoyment, in order for it to constitute a subdivision, there must be an allocation of a right to construct. Without a transfer of a right to build, the division does not constitute a subdivision

The attribute “observations” available in the database specifies the validity of the information.
This layer contains archived data. They are identifiable via the field named “archive” entered by “true”.
