PT3 easements concern private property easements for the benefit of operators of telecommunications networks (electronic communication) open to the public for the purpose of enabling the installation and operation of network equipment, including fixed and mobile very high-speed network equipment:
— on and in the parts of collective buildings and common-use subdivisions, including those capable of hosting radio installations or equipment;
— on the ground and in the basement of unbuilt properties, including those that can accommodate radio installations or equipment;
— above private property in so far as the operator confines himself to the use of the; installation of #x27; a third party benefiting from servitudes without compromising, where appropriate, the public service mission entrusted to that third party.
Installation of telecommunications network structures (electronic communication) shall not preclude the right of owners or co-owners to demolish, repair, modify or close their property. However, the owners or co-owners must, at least three months before they begin work likely to affect the works, notify the beneficiary of the easement.
Authorised operators’ agents must be provided with a certificate signed by the beneficiary of the easement and of #x27; the company to which the agent belongs to access the building, the subdivision or the unbuilt property.
Where, for the study, the realisation and the operation of the installations, the second; the introduction of these agents into private property is necessary, it is, in the absence of any; amicable agreement, authorised by the president of the tribunal de grande instance, ruling as in matters of interim measures, which shall ensure that the presence of the agents is necessary.
The beneficiary of the easement shall be liable for all damages arising from the equipment of the network. He is required to compensate all direct and certain damages caused both by the work of installation and d' maintenance and by the existence or operation of the works. In the absence of amicable agreement, the indemnity is fixed by the court of the expropriation seized by the most diligent party.
