Easements of public utility (SUP) are administrative limitations on the right of ownership established for the benefit of public persons (State, local authority, public institutions), service concessionaires or public works, private persons engaged in a business of #x27; general interest (concessionaires d' hydraulic power, pipes intended for the transport of chemicals, etc.).
They are created by specific laws and regulations, codified or not and have a character of a public order prohibiting individuals from unilaterally derogating from it.
They constitute charges which automatically exist on all the buildings (buildings or land) concerned and which may result either:
certain prohibitions or limitations on the use of land; exercise by owners of the right to occupy or use the land,
to support the execution of works or l' installation of certain works,
to impose certain obligations on homeowners (d & #x27 work; maintenance or repair work)
The creation of a public utility is based on two elements:
1. l' existence of a servitude-generating entity (monument, water courses, military works, transmission or distribution pipeline of #x27; water, gas, electricity, etc.) and
2. a generating event which may be a law or the result of a procedure (classification of #x27; a historical monument, inscription of n°#x27; a water course in the nomenclature of inland waterways or waterways.).
The SUPs are defined by Articles L.123-1 and L.126-1 of the Code de l'Urbanisme, their detailed list is provided as an annex to Article R.126-1. The list and a general plan of servitudes of public utility must be annexed to the local plan of urban planning (or POS) of each municipality.
