The Law of 29 July 1998 on the fight against exclusions, supplemented by several implementing decrees in 1999 and 2000, reformed the allocation of social rental housing. Thus, according to Article L 441-1-4 of the Construction and Housing Code, "where the housing situation justifies it in the light of the objectives of social mix and reception of disadvantaged people, the representative of the State in the department, after consulting the departmental commission of inter-communal cooperation and the departmental housing council, delimits housing basins that represent coherent areas of intervention in terms of housing policy and urban planning. These consist of the territories of several contiguous municipalities, one of which includes at least one or more sensitive urban areas (ZUS), or has more than 5,000 inhabitants and has a social rental housing stock representing more than 20 % of the main residences. They may also be constituted, at the request of the majority of the mayors concerned, by the territory of the agglomerated municipalities on which large settlement imbalances exist.
Municipalities located in such a defined habitat basin must create an inter-municipal housing conference within one year of the publication of the law of 19 July 1998.’ This conference, chaired by the representative of the mayors of the municipalities concerned, draws up an inter-municipal housing charter defining the distribution of quantitative targets for the reception of disadvantaged people in the social park of the housing basin. Since the SRU Act of 13 December 2000 (art. 60), representatives of public institutions of inter-communal cooperation concerned and competent in the field of local housing programmes have participated in the housing conference.
