The following point 4 is added in § 2 of the Niendorf 15 Building Plan Regulation of 5 March 1968 (Hamburgian Law and Ordinance Gazette, page 24): 4. Retail establishments shall not be permitted for the commercial area referred to as ‘A’ in the annexed summary plan; this does not apply to the newly formed parcels 5851, 5954 and 6140 of the Niendorf area. Retail establishments are permitted on the parcel 5851 with a maximum floor area of 1 200 m² and on parcels 5954 and 6140 with a maximum floor area of 5 000 m². Extensions and mergers of retail establishments on parcels 5954 and 6140, which in individual cases led to a floor area of more than 1 200 m², are inadmissible. Furthermore, in the area referred to as “A”, exemptions for gambling halls and similar undertakings within the meaning of § 33(i) of the Trade Code, which serve the installation of gaming equipment with or without the possibility of winning, are excluded.’
