The Regulation on the zoning plan Stellingen 49
of 3 September 1998 (HmbGVBl. P. 199) is as follows:

1. The attached “Appendix to the Regulation amending the Regulation on the Stellingen 49 development plan” is added to the Regulation.
2. In the drawing illustration of the laid down development plan Stellingen 49, the establishment of the closed construction method and the designation “(A)” are deleted in the industrial area. The fixing of a building height of 12 m to 14 m as a minimum and maximum dimension shall be changed to a building height of 14 m as a maximum.
3. Section 2 is amended as follows:

3.1.1 The first sentence is replaced by the following:
‘In the commercial area, airborne and odor-damaging establishments are listed in column 1 of the Regulation on installations requiring authorisation (4. BImSchV), as amended on 14 March 1997 (BGBl. I p. 505), as last amended on 15 July 2006 (BGBl. I p. 1619, 1623), inadmissible.’
3.1.2 The following sentences are added:
‘In the commercial area, noise-damaging establishments and installations shall be permitted if the requirements set out in point 6.1.1(e), in compliance with point 3.2 and in particular point 3.2.1 of the Technical Instructions for the Protection against Noise (TA Noise) of 26 August 1998, are complied with in the residential areas adjacent to the east. Exceptions for entertainment venues shall be excluded.’
Points 2 and 3 are deleted.
3.3 The previous paragraphs 4 to 8 shall become points 2 to 6.
3.4 The following point 7 is added:
7. For compensatory measures, the industrial area is allocated an area of approximately 4 860 m² of land area 4351 to the Stellingen area outside the planned area.
