Update of areas contaminated with nitrate — backdrop from 15.01.2022
According to § 2 of the NDüngGewNPVO of 3 May 2021, the territorial demarcation of the areas contaminated with nitrate and eutrophicated areas is based on the field blocks as of 1 February 2021.
If the cutting of field blocks changes after 1 February 2021, the newly cut field blocks form part of the area’s backdrop when their area is predominantly located in the designated areas. The updated status will be effective as of 15 January 2022 in accordance with the Land Regulation and presented on the LEA portal.
For the preparation of the updated nitrate backdrop valid on 15 January 2022, the latest field block geometries as of 1 October 2021 will be blended with the previous nitrate backdrop. A new field block geometry is thus affected by the regulations of the LandVO, if the area of the new field block is predominantly — i.e. more than 50 % — in the backdrop according to NDüngGewNPVO of 3 May 2021.
Since no technical reassessment of the emission risk for the field blocks can take place as of 1 October 2021, the previous basic maps for the identification of the emission risk pursuant to AVV GEA §§ 7-9 remain unchanged. This data set can therefore only be taken from whether a field block as of 1 October 2021 pursuant to § 2(2) of the NDüngGewNPVO is part of the backdrop updated on 15.01.2022.
