Legally protected biotopes pursuant to § 30 of the Federal Nature Conservation Act and § 24(2) of the Lower Saxony Execution Act to the Federal Nature Conservation Act.
Since 1990, certain biotope types have been under direct legal protection (formerly §§ 28a, b) of the Lower Saxony Nature Conservation Act (NNatG) due to their importance for the natural budget and biodiversity). From 1.3.2010, the Federal Nature Conservation Act (BNatSchG) in the version of 29.7.2009 in conjunction with the Lower Saxony Execution Act to the Federal Nature Conservation Act (NAGBNatSchG) of 19.2.2010 shall now apply. This has also led to changes in the legally protected biotopes.
In accordance with Paragraph 7(2)(4) of the BNatSchG, the term ‘biotope’ is a ‘living space for a community of wild animals and plants’. The legal protection refers to both the habitat and the associated community.
§ 30 BNatSchG protects a number of biotope types from significant and sustainable interventions. The quality of the protection should correspond to that of nature reserves.
