The property type includes all areas of the Department’s Nature Protection Compensation Measures included in the Compensation Register of Baden-Württemberg, which are part of the intervention regulation.
In general, the interference regime in the nature protection regulation and the planning intervention regulation are distinguished, which in turn are divided into compensation and eco-account measures. The interference regime is an instrument of nature protection law which, with its general prohibition of deterioration, is intended to ensure a minimum protection of nature and landscape even outside protected areas. By means of a binding sequence of decisions when authorising interventions, it is intended to counteract damage to nature and landscape and compensate for unavoidable impairments.
The nature protection regulation (§§ 13-18 of the Federal Nature Conservation Act (BNatSchG)) applies in external areas, for construction projects in external areas pursuant to Section 35 of the Baugesetzbuch (Baugesetzbuch) and in the case of building plans that replace a planning approval. The statutory obligation to maintain the list of compensation results from the Federal Nature Conservation Act (BNatSchG § 17 (6)): Procedures; Authorisation to issue ordinances) in conjunction with the Baden-Württemberg Nature Conservation Act (NatSchG § 18: Compensation list) and the Compensation Directory Regulation (KompVzVO § 1: Contents of the compensation directory).
