The Territorial Plan of Provincial Coordination is provided for and governed by Articles 14 and 15 of Law No 142/90, as well as by Legislative Decree 267/2000, and is also defined by Article 16 of Regional Law No 5/95 (replaced by the new Law 1/05). It is the instrument of spatial planning with which the Province plays, in the government of the territory, a role of programmatic coordination and connection between the territorial policies of the Region and the municipal urban planning. The PTC shall take into account the purposes and general rules for the protection and use of the territory and shall comply with the requirements of the regional P.I.T. and the corresponding technical instructions or explanatory circulars. The P.T.C. shall also take into account: the country and environmental planning acts drawn up pursuant to Regional Law No 52/82; the acts of Q.R.C.T. (Regional Framework for Territorial Coordination) approved pursuant to Article 4 of Regional Law 74/84; any planning agreements concluded between the Region, Province and Municipalities. Finally, it lays down criteria and parameters for the assessment of compatibility between the various forms and methods of utilisation of the essential resources of the territory. The Province of Massa Carrara approved the first PTC by Presidential Decree No 75 of 29 September 1999, in advance of the final approval of the regional TIP (which took place by means of Presidential Decree No 12 of 25/01/00). Therefore, a specific variant of compliance of the PTC with the PIT has been developed (approved by D.C.P. No 9 of 13/04/05). This variant consists of the elaboration of the fact-finding framework (which are an integral and substantial part of the P.T.C. itself) and of the project.
