Dataset description
This dataset makes it possible to visualise on a cartographic medium the geometries defining the buildings and their surrounding land enjoying legal protection by the State. There are two types of state protection:
1) Buildings classified as national monuments
Under the amended Act of 18 July 1983 on the conservation and protection of national sites and monuments, buildings, naked or built, whose conservation is archaeological, historical, artistic, aesthetic, scientific, technical or industrial, are classified as national monuments in whole or in part by the Government.
The effects of such a classification are as follows:
— Classification entails an obligation for the owner to apply to the Minister of Culture for authorisation to carry out work on the building.
In planning such works, the owner may call on the National Sites and Monuments Service, which advises the developer and, where appropriate, his architect on the future project free of charge.
— The owner of a classified building may receive a grant grant of up to 50 % of the costs incurred for restoration work under the Grand-Ducal Regulation of 19 December 2014 on the allocation of subsidies for restoration works.
2) Buildings entered in the supplementary inventory
Under the amended Act of 18 July 1983 on the conservation and protection of national sites and monuments, buildings, naked or built, whose conservation is archaeological, historical, artistic, aesthetic, scientific, technical or industrial, a public interest, which, without justifying a request for immediate classification, is of sufficient interest to make it desirable to preserve it, are included in a list known as an additional inventory.
The effects of such a listing are as follows:
— The inclusion of an immovable in the additional inventory of national sites and monuments entails an obligation on the owner not to make any modification of the building or part of the registered building without having, thirty days earlier, informed the Minister in writing of his intention and indicating the work he proposes to carry out. The Minister shall notify his response within 30 days of the filing of the request. He may inform the owner of his intention to initiate the classification procedure, which must then take place within three months of the filing of the application; after that period, the application is deemed to be approved.
In planning such works, the owner may call on the National Sites and Monuments Service, which advises the developer and, where appropriate, his architect on the future project free of charge.
— The owner of a registered building may receive a grant grant of up to 50 % of the costs incurred for restoration work under the Grand-Ducal Regulation of 19 December 2014 concerning the allocation of subsidies for restoration works.
Important note: The dataset is not exhaustive. It is completed and updated on an ad hoc basis. Geometries are produced for information purposes and have no enforceable legal value.
