Article 3.85 Activities Decision
• 1 No fertilisers shall be used within a cultivation-free zone as referred to in Article 3.79(2).
• 2 By way of derogation from paragraph 1, it shall be permitted to use fertilisers within a crop free zone at a distance of at least 25 centimetres from the insertion of a surface water body, when growing upwards and laterally sprayed tree nurseries or apples, pears and other seed fruits and stone fruits, if no crop other than grass is grown within that zone.
• 3 By way of derogation from paragraph 1, and without prejudice to paragraph 6, fertilisation of a catch crops on the cultivation-free zone at a distance of at least 50 centimetres from the entry of a surface water body shall be permitted if the catch crops meet the requirements laid down by ministerial order.
• 4 When using granular or powdered fertilisers on the strip adjacent to the cultivation-free zone, a device shall be used directly along the zone to prevent the spread of those fertilisers towards the surface water body.
• 5 When using leaf fertilisers on a strip located next to the cultivation-free zone, directly along the zone:
O a. when fertilising crops referred to in Article 3.80(1) and (4), the use of tippings which, on the side of the surface water body, achieve a vertical or almost vertical downward direction of the spray fluid and other low-drift caps not exceeding 50 centimetres above the crop or bare soil; or
O b. when fertilising crops referred to in Article 3.80(2) and (3), no equipment directed towards a surface water body.
• 6 The use of foliage fertilisers in the cultivation of a crop which does not maintain a cultivation-free zone pursuant to Article 3.79(7)(b)(2)(b) shall be subject to an emission screen which complies with the requirements laid down by ministerial regulation.
• 7 Paragraphs 2 and 3 shall not apply to the use of fertilisers along surface water bodies, as specified in the Annex to Article 3 of the Fertilisers Act Implementing Decree.
• 8 No fertilisers shall be used on land lying fallow within a distance of 50 centimetres from the insertion of a surface water body.
