Zgodnie z Ustawą o ochronie zabytków i opiece nad zabytkami z 2003 r. Pomnikami Historii mogą zostać zabytki nieruchome wpisane do rejestru lub parki kulturowe o szczególnej wartości dla kultury. Pomniki Historii są ustanawiane rozporządzeniem Prezydenta RP na wniosek Ministra Kultury i Dziedzictwa Narodowego.
