Servitude and Restriction of Public Utility (SRUP) — Buildings of Public Interest, in force in mainland Portugal.
The constitution of servitudes and restrictions of public utility related to Buildings of Public Interest follows the regime provided for in the law, being inserted within the scope of the Edified Heritage. Buildings or other buildings of public interest not classified as a national monument or as public interest immovable property are subject to protective measures, provided that the entities responsible for the conservation and management of such buildings or buildings so request.
Buildings and buildings of public interest, not classified as a national monument or as buildings of public interest, such as school, hospital, administrative and religious facilities, barracks, bridges, dams, may have a protection area the extent of which varies depending on the use of the building or construction, the values to be protected (aesthetic or other nature) and the occupation of the surrounding land.
The protection zones shall be fixed by order or decree of the Minister responsible for the Environment and Spatial Planning, on a proposal from the competent public authority, upon the opinion of the Regional Coordination and Development Committee (CCDR) territorially competent.
Interested entities may propose to the member of the competent Government the establishment of the protection areas of public buildings built, under construction or already designed, after hearing the respective City Council.
The ordinance or decree establishing the protection zone shall be published in the Diário da República with an indication of the respective limits and conditions.
