SRUP — Forestry Regime

Servitude and Restriction of Public Utility (SRUP) — Forestry Regime, in force in mainland Portugal. The establishment of servitudes and restrictions of public utility related to the Forestry Regime follows the regime provided for in the law, being inserted within the scope of Natural Resources. The Forestry Scheme comprises the set of provisions designed to ensure not only the creation, exploitation and conservation of forest wealth from the point of view of the national economy, but also the forest lining of land whose afforestation is of public utility and appropriate or necessary for the good water regime and protection of floodplains, for the enhancement of burnt plains and the benefit of the climate, or for the fixation and conservation of the soil in the mountains and sands of the sea coast. The submission of any land or forest to the forest regime, as well as its exclusion from this regime, is made by decree, which will be preceded by the declaration of public utility of the afforestation of these lands. Each decree concerns a perimeter and may refer to one or more of its polygons. The total forestry regime applies to land, dunes and forests of the State or which will belong to it by expropriation. The partial forestry regime applies to land and forests of other entities or individuals. The partial forestry scheme comprises three categories: mandatory, optional and police.
