Dataset description
Servitude and Restriction of Public Utility (SRUP) — National Defense, in force in Continental Portugal.
The establishment of servitudes and restrictions of public utility relating to military organisations or installations follows the regime provided for in the law, being included in the scope of the Equipment. Military organisations or installations have protected areas with a view to ensuring not only their security, but also the safety of persons and property in the confined areas and also to enable the armed forces to carry out their tasks, in the exercise of their normal activity or within military operations plans.
Military organisations or installations shall comprise:
organisations or facilities assigned to the conduct of military operations, such as fortifications, fixed artillery batteries, military roads, military or civilian aerodromes and defence facilities of any kind and any other part of the defence plans;
organisations or facilities assigned to the preparation or maintenance of the armed forces, such as barracks, training camps, shooting careers and polygons, military manufacturing establishments, warehouses of war material, ammunition and explosives, mobilisation or fuel, and any other for the equipment and efficiency of the same forces.
The areas confined to these organisations or facilities are subject to military servitude.
Military servitudes are constituted, modified or extinguished, in each case by decree of the Minister responsible for the area of National Defense and when servitude is of interest to more than one entity, as is the case with some aerodromes, the decree shall be joint of the Ministers or Heads of State of the departments concerned.
Servitudes in areas confined to organisations or facilities assigned to the performance of military operations are classified as general servitudes or particular servitudes. The area subject to servitude must be perfectly defined in the decree constituting servitude and if this is not identified general servitude shall be 1 km wide. In any case, the width of the servitude shall be determined to the full extent from the perimeter of the area occupied by the organisation or installation concerned, and shall not exceed 3 km.
Security zones are areas containing organisations or facilities assigned to the preparation or maintenance of the armed forces, in particular during periods of manoeuvre or concentration and where servitudes are constituted.
