Formations of the Board of Appeal of Industrial Property

The Board of Appeal of Industrial Property (hereinafter — the Board of Appeal) is a collegial decision-making body appointed by the Cabinet to examine out-of-court disputes between patents for inventions (including supplementary protection certificates for medicinal products and plant protection products), trademarks, designs and topographies of semiconductor products (hereinafter — industrial property objects) arising from the registration and post-registration procedures of industrial property objects. The purpose of the Board of Appeal’s activities is to examine out-of-court disputes arising from registration and post-registration procedures, as well as to ensure the exercise of earlier rights under industrial property laws and regulations in post-registration procedures. The Board of Appeal shall examine the following disputes provided for in the laws and regulations on industrial property: 1) regarding a decision of the Patent Office, which has been taken in the registration or post-registration procedure and regarding which an appellate application (appeal cases) has been submitted; 2) regarding the registration of an industrial property object against which a third party opposition application (opposition cases) has been submitted.
